My Drink Diary

Terms of Use

These Terms define the conditions for using “My Drink Diary” (the “Service” or “App”), provided by Brain Bloom LLC (the “Company”). Please use the Service after agreeing to these Terms. Apple users are subject to these Terms in addition to Apple’s Standard End User License Agreement (EULA).

Last updated: November 5, 2026

Article 1 (Application)

1. These Terms apply to all relationships between users and the Company concerning use of the Service.

2. The Company may establish rules and other provisions concerning the Service ("Individual Provisions"). These Individual Provisions form part of these Terms regardless of their name.

3. If these Terms and Individual Provisions conflict, the Individual Provisions take precedence unless they state otherwise.

Article 2 (Use of the Service)

1. The Service can be used without user registration.

2. The Service is a personal drink diary for people of legal drinking age in their place of residence. In Japan, it is intended for people aged 20 and over.

3. Users are responsible for providing, at their own expense, the devices, internet access and other equipment needed to use the Service.

4. Rights to entries and photos saved by users remain with the user or the lawful rights holder.

Article 3 (Management of Devices and Store Accounts, and iCloud Sync)

1. Users are responsible for appropriately managing their devices and Apple Account used for the Service.

2. Entries, photos and drinking guide settings are stored on the device and, when the user enables iCloud sync, synced between devices using the same Apple Account through its private iCloud space. Network conditions, storage capacity and OS restrictions may delay sync or widget updates.

3. Users should back up entries and photos as needed before changing devices or in case of device failure. Stopping sync does not delete on-device entries or existing iCloud data. Deleting iCloud data is a separate action in the App’s settings. Recovery of deleted entries or lost data is not guaranteed.

4. The App’s iCloud sync feature is free. Apple’s terms apply to iCloud use. Users are responsible for ensuring sufficient storage and for any paid storage fees charged by Apple.

Article 4 (Fees and Payment Methods)

1. Fees, payment timing and other conditions for paid features are displayed on the in-app purchase screen.

2. Payments are made through the payment system provided by Apple Inc. and are subject to the App Store’s terms and conditions.

3. Monthly and annual subscriptions renew automatically for the displayed period unless the user cancels through the App Store. The one-time purchase does not renew.

4. Entries, search, photo calendars, widgets, iCloud sync and manual backups are free. The free plan displays banner ads. All paid plans provide ad removal.

5. The one-time plan is a single purchase to remove ads within this App.

Article 5 (Prohibited Activities)

Users must not engage in the following activities when using the Service:

1. Activities that violate laws or public order and morals.

2. Infringement of copyrights, trademarks or other intellectual property rights included in the Service.

3. Copying, modifying, analyzing, reverse engineering or redistributing the Service, except as permitted by law.

4. Disrupting, overloading or gaining unauthorized access to the Service or related systems, servers or networks.

5. Using the Service for unlawful purposes or commercial purposes not authorized by the Company.

6. Misusing in-app purchases or refund mechanisms.

7. Providing direct or indirect benefits to organized crime groups or similar antisocial organizations.

8. Saving or sharing content that infringes third-party rights or privacy, or encouraging illegal drinking or driving after drinking.

9. Other activities the Company reasonably considers inappropriate for operation of the Service.

Article 6 (Suspension of the Service)

1. The Company may suspend or interrupt all or part of the Service in the following circumstances:

1-1. Maintenance or updates to systems relating to the Service.

1-3. Earthquakes, lightning, fire, power failures, communication failures or other events beyond the Company’s control.

1-4. Other circumstances requiring action to provide the Service safely and reliably.

2. Where advance notice is possible, the Company will notify users through the Service, this website or another appropriate method.

Article 7 (Restrictions on Use)

1. The Company may restrict all or part of the Service if it determines that a user falls under any of the following:

1-1. Violation of any provision of these Terms.

1-2. Use of the Service for unlawful purposes.

1-3. Membership in or involvement with organized crime groups or similar antisocial organizations.

1-4. Infringement of the rights or interests of the Company or a third party.

1-5. Other circumstances in which the Company reasonably considers continued use inappropriate for operation of the Service.

Article 8 (Cancellation of Subscriptions)

1. Users can cancel subscriptions through the subscription management screen for their Apple Account.

2. Deleting the App from a device does not cancel a subscription.

3. After cancellation, paid features remain available until the end of the current period shown by the App Store.

4. Refund eligibility is reviewed under the App Store’s refund policy and applicable law.

5. Restore purchases using the same Apple Account used for the purchase. Restoring purchases does not restore diary entries or photos.

Article 9 (Disclaimers and Liability)

1. The Company endeavors to provide accurate and up-to-date information and content, but does not guarantee their accuracy, completeness, currency, usefulness or suitability for a particular purpose. The Company does not guarantee that the Service is free from factual or legal defects, including defects in safety, reliability, effectiveness, suitability, security, errors, bugs or infringement of rights.

2. The Company is not liable for damage arising from use of the Service except where caused by its intentional act or negligence.

3. Where damage is caused by the Company’s ordinary negligence, its liability is limited to ordinary and direct damage, unless such a limitation is not permitted by law.

4. The preceding limitation does not apply where damage is caused by the Company’s intentional act or gross negligence.

5. Pure alcohol amounts and drinking guides are reference values for reflecting on entries based on the information entered. They do not indicate medically recommended amounts, safe drinking limits or permission to drive.

Article 10 (Changes to the Service)

The Company may change or discontinue the Service. For changes or discontinuation that materially affect users, the Company will provide reasonable advance notice through the Service, this website or another appropriate method, except in an emergency.

When discontinuing the Service, the Company will explain the end date, whether any features will remain usable and which ones, and how to export entries and photos, through the Service, this website or another appropriate channel.

Article 11 (Changes to These Terms)

The Company may change these Terms as needed due to changes in law, the Service or other circumstances. Important changes will be announced through the Service, this website or another appropriate method. Revised Terms apply from the effective date specified when published. Separate consent will be requested where required by law.

Article 12 (Handling of Personal Information)

1. The App does not require user registration and does not collect diary entries or photos on the Company’s servers. The Company does not obtain or store payment card numbers, bank account details or other payment method information.

2. The Company uses services provided by RevenueCat, Inc. to verify purchases, restore purchases, provide paid features and prevent misuse. Anonymous app user IDs generated by RevenueCat, device type and OS, purchase history, product IDs, subscription status and other information required for purchase processing are sent to and processed by RevenueCat.

3. The free plan displays Google AdMob banner ads. iCloud sync, advertising and other information handling follow the Company’s Privacy Policy.

Article 13 (Notices and Contact)

The Company will notify users through the Service, this website or another method it considers appropriate. Users should contact the Company through the contact information provided on this website.

Article 14 (Prohibition of Assignment)

Users may not assign their contractual position or rights or obligations under these Terms to a third party, or provide them as security, without the Company’s prior written consent.

Article 15 (Governing Law and Jurisdiction)

These Terms are governed by Japanese law.

Disputes relating to the Service are subject to the exclusive agreed jurisdiction of the court with jurisdiction over the Company’s registered office.

This does not limit mandatory consumer protection rights under the laws of your place of residence.
